These Terms of Service ("Terms") form a binding agreement between you ("Customer", "you") and SurfNode Ltd, a company registered in England & Wales (Company No. 16586366) ("SurfNode", "we", "us"). By creating an account, purchasing a service, or using any part of our hosting platform, you confirm that you have read, understood, and agree to these Terms.
1. Eligibility & Account
You must be at least 18 years old, or the legal age of majority in your jurisdiction, to purchase services. You are responsible for keeping your account credentials secure and for all activity that occurs under your account.
2. Services
SurfNode provides game server hosting, web hosting, virtual private servers, and related infrastructure. Service specifications (CPU, RAM, storage, bandwidth) are described on the relevant product page at the time of purchase.
3. Fees, Billing & Renewals
- Services are billed in advance for the term you select (monthly, quarterly, annually).
- All prices are in GBP unless stated otherwise and exclude VAT where applicable.
- Renewals are processed automatically using your stored payment method.
- Failure to pay an invoice within 7 days of the due date may result in service suspension.
4. Acceptable Use
Your use of our services is subject to our Acceptable Use Policy. Violations may result in suspension or termination without refund.
5. Service Levels
Our uptime commitments and service credits are defined in our Service Level Agreement.
6. Customer Data & Backups
You retain ownership of all data you upload. While we maintain redundant infrastructure, you remain responsible for keeping independent backups of any data you cannot afford to lose.
7. Suspension & Termination
We may suspend or terminate services for non-payment, breach of these Terms, or activity that threatens the integrity of our network. You may cancel at any time from your client area; refunds are governed by our Refund Policy.
8. Limitation of Liability
To the maximum extent permitted by law, SurfNode's total liability arising out of or in connection with the services in any 12-month period shall not exceed the fees paid by you for the affected service in that period. We are not liable for indirect, incidental, or consequential losses, including lost profits or data.
9. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email or via your client area at least 14 days before they take effect.
10. Governing Law
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising from these Terms.
